Open Play Network Terms of Service

Open Play Network is a platform that helps tennis players find other players, schedule matches, log results, view rankings, and participate in tennis-related leagues, ladders, events, and communities.

Open Play Network does not own or operate tennis courts, supervise matches, provide officials, provide medical services, run background checks, or guarantee the conduct, identity, skill level, safety, or reliability of any user.

Users are responsible for their own safety, scheduling, transportation, equipment, court access, and compliance with court or facility rules.

You must be at least 13 years old to use Open Play Network.

If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.

We may suspend or remove any account if we believe the user is not eligible or is using the Service in an unsafe, unlawful, or abusive way.

You agree to provide accurate account information and keep your login information secure.

You may not impersonate another person, create fake accounts, use someone else’s account, or provide false information about your identity, age, skill level, or match history.

You are responsible for activity that occurs under your account.

Open Play Network may allow users to create profiles, log matches, display match history, and participate in rankings, ratings, Elo-style scores, ladders, or leaderboards.

These features are for recreational and informational purposes only. Rankings and ratings may be incomplete, inaccurate, experimental, or affected by limited data, incorrect results, disputed matches, defaults, no-shows, or algorithm changes.

We may adjust, remove, reset, or recalculate rankings, ratings, match results, leaderboards, or player records at any time.

You agree not to submit false results, manipulate rankings, create fake matches, or abuse the scoring system.

You agree not to:

• harass, threaten, stalk, bully, or abuse another user;
• use hateful, sexually explicit, violent, or discriminatory language;
• submit false match results;
• spam users or use the Service for unauthorized advertising;
• misuse messaging or scheduling features;
• violate court, park, club, school, or facility rules;
• use the Service for illegal, unsafe, or fraudulent activity;
• scrape, copy, attack, reverse engineer, or interfere with the Service;
• create multiple accounts to evade restrictions or manipulate rankings.

We may remove content, restrict features, suspend accounts, or terminate accounts if we believe a user has violated these Terms or created risk for other users or the Service.

Open Play Network may help users find and schedule matches, but users decide whether, when, where, and with whom to play.

You are responsible for using good judgment when meeting other users. You should meet in public places, follow facility rules, and stop any interaction that feels unsafe or inappropriate.

We are not responsible for no-shows, cancellations, disputes, unsafe conduct, injuries, property damage, or anything that happens before, during, or after a match or meetup.

Tennis and related activities involve risk. These risks include, but are not limited to, slips, falls, collisions, muscle injuries, joint injuries, heat illness, dehydration, cardiac events, being hit by balls or racquets, unsafe court conditions, weather, equipment issues, travel risks, illness exposure, and the actions of other users or third parties.

By using Open Play Network or participating in any match, league, ladder, event, meetup, or tennis-related activity, you knowingly and voluntarily assume these risks.

You are responsible for deciding whether you are physically able to play tennis. If you have health concerns, you should consult a medical professional before participating.

To the fullest extent allowed by law, you release Lone Star Badger LLC, Open Play Network, and their owners, members, managers, employees, contractors, service providers, affiliates, and agents from claims, damages, losses, liabilities, costs, and expenses arising from:

• your use of the Service;
• your participation in tennis or related activities;
• your interactions with other users;
• injuries, illness, death, or property damage;
• user conduct, no-shows, disputes, or false match results;
• court, facility, park, or weather conditions;
• rankings, ratings, match history, or leaderboard placement.

This release does not apply to claims that cannot legally be released.

Some features may be free, and others may require payment, including leagues, events, subscriptions, premium features, credits, or other offerings.

If you make a payment, you authorize us or our payment processor to charge the applicable amount.

Unless otherwise stated at the time of purchase, payments are non-refundable except where required by law.

We may change prices, features, payment terms, or offerings at any time.

You may be able to submit profile information, photos, messages, match results, comments, availability, or other content.

You retain ownership of your content, but you give Open Play Network permission to use, display, store, reproduce, modify, and share your content as needed to operate, improve, and promote the Service.

You are responsible for the content you submit. You may not submit content that is false, illegal, abusive, infringing, private, or harmful.

We may remove content at any time if we believe it violates these Terms or creates risk.

Your use of Open Play Network is also governed by our Privacy Policy, which explains how we collect, use, and share information.

By using the Service, you agree to our Privacy Policy.

Open Play Network may reference courts, parks, clubs, schools, facilities, maps, links, payment processors, analytics tools, or other third-party services.

We do not control these third parties and are not responsible for their rules, availability, pricing, safety, conditions, services, or information.

You are responsible for confirming court availability, access, fees, rules, and conditions before playing.

We may modify, suspend, discontinue, restrict, or remove any part of the Service at any time.

We do not guarantee that the Service will always be available, error-free, secure, or uninterrupted.

You may stop using Open Play Network at any time.

We may suspend or terminate your account if we believe you violated these Terms, created risk, submitted false information, abused the Service, failed to pay required fees, or acted in a way that harms users or Open Play Network.

Some information may be retained after account deletion where needed for legal, safety, fraud prevention, backup, accounting, dispute resolution, or platform integrity reasons.

Open Play Network is provided “as is” and “as available.”

We do not guarantee that the Service will help you find matches, improve your tennis ability, provide accurate rankings, prevent disputes, prevent injuries, or ensure safe interactions with other users.

To the fullest extent allowed by law, we disclaim all warranties, express or implied.

To the fullest extent allowed by law, Lone Star Badger LLC, Open Play Network, and their owners, members, managers, employees, contractors, service providers, affiliates, and agents will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages.

To the fullest extent allowed by law, our total liability for any claim related to the Service will not exceed the greater of:

(a) the amount you paid to Open Play Network in the six months before the claim arose; or
(b) $100.

You agree to defend and hold harmless Lone Star Badger LLC, Open Play Network, and their owners, members, managers, employees, contractors, service providers, affiliates, and agents from claims, losses, damages, liabilities, costs, and expenses arising from:

• your use of the Service;
• your violation of these Terms;
• your content;
• your interaction with another user;
• your participation in tennis or related activities;
• your false match results or misuse of rankings;
• your violation of law or third-party rights.

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles.

Any dispute related to these Terms or the Service will be brought in the state or federal courts located in Wisconsin, unless applicable law requires otherwise.

We may update these Terms from time to time. If we make changes, we may update the effective date or provide notice through the Service.

Your continued use of Open Play Network after updated Terms are posted means you accept the updated Terms.
